Notification of Pesticide Use

The Fairport School District has always used caution, and continues to be cautious, in the use of pesticides to limit the likelihood of inadvertent exposure to these products. During the year, pesticide products may be used at school facilities or on school grounds.

As required by state and education law, the district maintains a list of parents/guardians and staff who wish to receive 48-hour written notification of certain pesticide applications at their schools.

Notification is NOT required if a school remains unoccupied for a continuous 72-hour period following an application. Also, the following pesticide applications are not subject to prior notification.

  • Anti-microbial products
  • Non-volatile rodenticides in tamper resistant bait stations in areas inaccessible to children
  • Non-volatile insecticidal baits in tamper resistant bait stations in areas inaccessible to children
  • Silica gels and other non-volatile ready-to-use pastes, foams, or gels in areas inaccessible to children
  • Boric acid and disodium octaborate tetrahydrate
  • EPA designated biopesticides
  • EPA designated exempt materials under 40CFR152.25
  • Aerosol products with a directed spray in containers of 18 fluid ounces or less when used to protect individuals from an imminent threat from stinging and biting insects including venomous spiders, bees, wasps, and hornets.

If you would like to receive 48-hour notification of pesticide applications that are scheduled to occur in or around a school/building, please contact Aaron Smith at 585-421-2046. If an emergency application is necessary to protect against an imminent threat to human life, a good faith effort will be made to provide written notification to those on the 48-hour prior notification list.

Asbestos Compliance

The federal Asbestos Hazard Emergency Response Act (AHERA) was signed into law in 1986. It requires public schools to inspect all buildings that are leased, owned, or otherwise used as school buildings for the presence of asbestos-containing building materials. The U.S. Environmental Protection Agency (EPA) published regulations and enforces AHERA.

The AHERA regulations require public school districts and non-profit schools to:

  • Perform an original inspection to determine whether asbestos-containing materials are present and then re-inspect asbestos-containing material in each school every three years
  • Develop, maintain, and update an asbestos management plan and keep a copy at the school
  • Provide yearly notification to parent, teacher, and employee organizations on the availability of the school's asbestos management plan and any asbestos-related actions taken or planned in the school
  • Designate a contact person to ensure the responsibilities of the public school district or the non-profit school are properly implemented
  • Perform periodic surveillance of known or suspected asbestos-containing building material
  • Ensure that trained and licensed professionals perform inspections and take response actions
  • Provide custodial staff with asbestos-awareness training

 

By federal law, all schools are required to inspect and develop a management plan for asbestos. Details of all asbestos activities are described in the District’s management plan, which is available for review at the Office of Buildings & Grounds, 140 Hulburt Road.

For each preventative measure or response taken to comply with the management plan, there is a detailed description of the activity, location, and reasons for the activity. If asbestos was removed, the name and location of the storage disposal site are noted.

Activities, including the training of the maintenance staff to increase their awareness of asbestos and to prevent disturbance while making daily surveillance checks, were implemented to ensure a safer environment for staff and students.

District facilities are reinspected every six months to remain in federal and state compliance. These inspections ensure that the Fairport Central School District has responded to the management plan which will continue to provide an environment clean and free from asbestos.


 

All outside workers or contractors entering Fairport Central School District buildings must complete and sign the Asbestos Work Clearance Form, acknowledging the presence of asbestos containing building materials in this building. They are required to review the AHERA Management Plan for this building and the diagrams indicating where known or assumed ACBM is located. No work will be allowed in any area in which asbestos containing materials are present without prior approval of the LEA designated person, Aaron Smith, Director of Facilities.
 
If at any time while working in the school building the contractor disturbs any asbestos containing material or assumed asbestos containing building materials, all work must be stopped and the building custodian and LEA designated person must be notified as soon as possible.

Project managers for contractors with multiple employees working in the school building may sign in on their behalf signifying that he or she is aware of the above requirements and that this information is conveyed to his or her employees. The
